CHARGE COURTS LIABILITY WAIVER
This liability waiver applies to all activities, including individual court/lane rentals, drop-in plays, events, practices, gym sessions, tournaments, and matches conducted at Charge pickleball courts, 125 Eliza St, Meaford (hereinafter referred to as ‘CHARGE COURTS’), whether at any CHARGE COURTS branch or organized by CHARGE COURTS and held at an alternate location.
In consideration of the privilege to participate, I acknowledge and agree to the following terms:
1. ASSUMPTION OF RISK.
I, on behalf of myself, my minor, and/or our team, assume all risks that may arise from participating in the activities, including but not limited to the athletic activity itself, the use of equipment, facilities, the actions of others, or the unavailability of emergency care, as well as any risks described in the preceding paragraph.
2. INDEMNITY / HOLD HARMLESS.
I, on behalf of myself, my minor, and/or our team, personal representatives, and/or assignees, agree to indemnify and hold CHARGE COURTS, along with their affiliates, parents, subsidiaries, assigns, partners, attorneys, members, employees, independent contractors, shareholders, officers, directors, and agents, as well as any producers, investors, cast members, or any other entities associated in any way with the creation, production, or distribution of media (DVDs, websites), harmless from any and all claims, lawsuits, arbitrations, expenses, judgments, costs, fees, damages, or liabilities, including attorneys’ fees, arising from my or my team’s participation in the activities.
3. RELEASE/WAIVER.
In consideration of being permitted to participate in the activities, I, on behalf of myself, my minor, and/or our team, personal representatives, and assigns, hereby release, waive, and discharge CHARGE COURTS from any liability associated with or related to my, my minor’s, or my team’s participation in the activities. I further agree not to pursue legal action against CHARGE COURTS for any injuries, accidents, illnesses, or property loss, whether known or unknown, anticipated or unanticipated, related to the activities.
4. ACKNOWLEDGMENT OF RISK.
I understand and acknowledge that I am voluntarily participating in activities that carry both known and unknown risks, including severe injuries, permanent disabilities, and even death. These risks may arise from my own actions, omissions, or negligence, as well as the actions, omissions, or negligence of others, including but not limited to CHARGE COURTS, the rules of play, premises conditions, or equipment used. I willingly accept all such risks as a condition of participation and take full responsibility for any resulting damages.
5. MEDICAL EXPENSES.
I accept full responsibility for any medical expenses incurred, regardless of insurance coverage. In the event of an emergency, accident, or illness, I authorize ambulance transportation to a hospital and grant permission for medical professionals to provide necessary treatment, diagnostics, or procedures at my own expense. I do not hold CHARGE COURTS liable for the outcomes of such medical treatment. 6. NO INSURANCE.
I acknowledge that CHARGE COURTS does not provide any insurance coverage on behalf of myself, my minor, or my team.
7. WAIVER OF LEGAL RIGHTS.
I understand and acknowledge that by signing this agreement, I am waiving valuable legal rights, and I unconditionally agree to release, indemnify, and refrain from taking legal action against the officers, directors, administrators, agents, coaches, staff, volunteers, sponsors, and advertisers associated with CHARGE COURTS.
8. SEVERABILITY.
I understand and agree that this waiver is intended to be as broad and inclusive as permitted by applicable law. If any portion of this agreement is found to be invalid, the remainder shall remain in full force and effect, and the invalid portion shall be interpreted to afford the greatest protection to CHARGE COURTS as permitted by law.
9. COURT/LANE DESIGNATION.
The lane and court numbers displayed on the booking portal are for management purposes only. Court/lane assignments will be made by the staff upon arrival at the facility.
10. PHOTOGRAPHY CONSENT.
I, on behalf of myself, my minor, and/or my team, grant permission to CHARGE COURTS to record, film, photograph, or videotape our name, image, and activities for promotional purposes, including publication on the CHARGE COURTS website, social media, and within the facility. I waive the right to review or approve such materials and acknowledge that CHARGE COURTS is not responsible for any unauthorized use of these depictions outside of their control.
11. COVID-19 WAIVER.
Anyone exhibiting symptoms of COVID-19 or having close contact with a confirmed case should refrain from participating in activities. Participants are encouraged to conduct a self-assessment via the Ontario Ministry of Health’s website before attending, and those who do not pass the assessment should self-isolate at home. Participants who develop symptoms during an activity must leave immediately and self-isolate.
By filling the form, I, on behalf of myself, my minor, and/or our team, confirm that I have read and understand the terms outlined in this waiver and agree to abide by them.
